I don't think you have any come back on a manufacturer if you haven't left a car in gear. Sorry to sound harsh.
Handbrakes shouldn't be 100% relied on as components can and do fail - and a rolling car is dangerous. If pointing up a hill, leave the car in a forward gear such as 1st, and if pointing down hill leave it in reverse. As Tigger says if its really steep turn the wheels in towards a kerb. Good luck with repairs though.
