Same here in the UK. The insurance company will pay market value (less any excess). The insurance company would have a potential right of subrogation against the dealership.

Like you, I don't think that the dealer will accept any responsibility. There's just no evidence unless MINI UK can come up with anything. That leaves the insurance route - and complaints to MINI UK.
