In the UK the pothole has to be 45mm deep inorder for it to be repaired, on the class of road where our problem occurred the council are obliged to inspect the road once every three months.
If a pothole occurs in the three month period unless someone has reported it to the council they are exonerated from blame as they have carried out thier duties. My argument was that the road could not of been inspected properly due to rainfall.
If anyone has a similar problem to mine my advice would be to get a friend to write and complain about the state of the road and then submit a claim

the council will always try via their insurers to wriggle out of paying infact in my case the claim falls well below the councils excess, they use the insurers to handle the claim.
