: Potential CVT failure - Is it covered by my dealer warranty?

Hello all and thank you for a great forum and resource. First time poster here :).

I bought a used 2003 Mini Cooper with the CVT auto gearbox last week. It now seems to have developed a fault (!), whereby the gearbox does not seem to shift up into the higher gears whilst driving. It just keeps revving and making a lot of noise.

I'm now concerned this might be the dreaded CVT failure that I consequently have read a lot about on this forum.

The car is under a dealer warranty, and it was collected by their recovery vehicle today. I have posted the wording from their dealer warranty document below. Is anyone more technically capable able to tell me if this should be covered by the dealer?

I'm just looking for a little bit more knowledge if the dealer calls me back and is not prepared to cover the fault.

Any advice much appreciated!

Excerpt from doc:
Parts covered: Gearbox: All internal components, comprising gears, shafts, syncro hubs and baulk rings, selector shafts and selector forks, internal bearings and bushes, oil pump, valves and valve block, automatic gearbox clutches and brake bands, governor, torque convertor (excluding external linkages and oil leaks).

UPDATE: I got a call from a dealer with some good news. The car is currently at BMW. It seems the CVT box is fine, and that the car just needs to have the clutches synchronized. As explained in this post in the CVT FAQ thread (http://www.mini2.com/forum/first-generation-cvt-automatic/41926-cvt-faq-draft-discussion.html#post611027), it would explain why the car seemed to be sticking in first gear.

What puzzles me is that the car drove fine back from the dealer, and only started playing up the next morning, after I had already driven approximately 15 miles?
