Im currently looking at swapping the alloys on my car, the question I have is will a 17x8 et38 fit with 215 tyres fit without interfering with any bits?

Depends whether your car is lowered and what size 215/45-17 or 215/40-17.

40 profile tyres fella, the car isn't lowered as yet, if indomwhats the limit I could go to?

215/40-17 should be OK on stock suspension. ET38 is a pretty low offset for a lowered 1st Gen MINI. Can't say how low (if at all) you could go with this tire size.
