On May 2nd Caz was driving down a local road (back from the Pub). She passed an on coming car and hit a pothole. My car is fitted with Technomagnesio F1 wheels (18) the shock was such that it turned the CD player off :bad: :bad: and buckled two of the wheels.

I went out with the camera and took pictures the pothole was 85mm deep. I wrote a letter of complaint to the council and enclosed the piccies.

The council passed the details onto thier insurers to handle the claim.

I was dissapointed to have the claim rejected on the grounds that the road was inspected on April 27th and no defects were found. In a phone conversation with the insurers the said that the council had fulfilled its obligations and given that no one else had complained they were not liable for the damage. The road had by this time been repaierd.

Quite clearly I was dissapointed with the outcome................then it dawned on me that what happens in April.................RAIN :D :D

Big thanks to LorraineH for finding the Met office website and weather reports for April.....................Torrential rain fell on the 26/27th........................Me thinks is it possible that the council have failed in their duties and inspected a road in bad weather conditions????? Time for another chat with the insurers.

The case was re opened and today I've finally got a result, they admitted liability :D :D .

thanks for that info Brushy, a similar thing has happened to my friend and the council are refusing to own up that the road was in a terrible condition, I'll pass on the info to him.

Maby if enough people started billing the councils for damage to their cars they would think about inproving the roads

In the UK the pothole has to be 45mm deep inorder for it to be repaired, on the class of road where our problem occurred the council are obliged to inspect the road once every three months.

If a pothole occurs in the three month period unless someone has reported it to the council they are exonerated from blame as they have carried out thier duties. My argument was that the road could not of been inspected properly due to rainfall.

If anyone has a similar problem to mine my advice would be to get a friend to write and complain about the state of the road and then submit a claim ;) the council will always try via their insurers to wriggle out of paying infact in my case the claim falls well below the councils excess, they use the insurers to handle the claim.

Nice on well done Brushy - sounds like you more than deserved to get the compensation, what I dont understand is that if you are sticking to the speed limit driving down a road normally etc etc and you go down a pothole and it damages your wheel, wether the council have inspected that road recently or not the fact is it damaged your wheels due to the council not maintaing the road properly so they owe you wether theres been an inspection or not surely?
If they used all the stuff that they make the harsh speed bumps with to fill in the potholes , im sure we would have a hell of alot more pothole free roads :D rant over

A lot of people are and it has resulted in an ever increasing portion of the road repair budget being allocated to meet claims. That leaves less money to repair the roads and leads to more claims. Don't ask me what the answer is!
