Offline | how to make a consumer complaint (NSW) i'm wondering if anyone here is familiar with lodging a consumer complaint in NSW. i'm writing from canada. a few weeks ago i emailed a sydney aftermarket shop to buy an item. his email response said he had several in stock, and would ship it within 24 hours of receiving payment. i paid him on april 30, and heard back that he would be receiving some of the items in the next few days and he'd let me know as soon as it arrived and was shipped. well, it's a few weeks and i haven't had any response to my emails for an update. since then i've read similar complaints on other forums about the same shop. as a courtesy, i'll probably give him another week, but i'm just planning how to respond. i intend to make a consumer complaint based on false statement/representation that he had the items in stock and would ship within 24 hours of receiving payment, and i intend to email the complaint to this address: http://www.fairtrading.nsw.gov.au/ic...thandling.html any NSW consumer lawyers out there? does this seem the appropriate claim and process? thx. |

| Whatev. | Not a consumer lawyer, am a NSW consumer - fair trading is probably your best recourse at this point. Like your link says: they will contact the shop and tell him about the complaint and give him the chance to make good on his agreement with you. Should he refuse, you can then take him to the tribunal which will hear the case and rule according to the facts. I had a client lodge a complaint with fair trading recently because he misunderstood something I had told him. I had already righted things with him when the complaint came through, however it was enough to frighten me (but then again, I care if I upset a customer). Might not be enough to scare your guy though. Even so, it is the appropriate channel to take. They do seem to act quite quickly too (for a government department) - it won't take weeks for them to contact him. ![]() |
