Warning about Momentum MINI - Houston

I hate to bring bad news about a dealership, but I just wanted to warn a few people before it happens to another person.

We bought an 03 MCS last spring and have loved the car. A friend of ours ordered a Chili Red Cooper after she went for a ride in ours. She tracked the vehicle, kept in contact with the dealer and last Thursday she was called by the dealer to be notified that her car was in. Great! So she gets them to fax a loan application, directs them to install window tint and floor matts. She sends the loan app. back in and tells them that she will be there on Friday afternoon or Saturday morning to pick up the car and sign the paperwork.

Friday around lunchtime, she gets a call from the manager of the Mini part of the dealership. He states that he had been trying repeatedly to get in touch with her and that since she didn't return his calls, her car was sold at lunch. The best part is that he repeatedly left messages on her cell phone, and she doesn't even own a cell phone. Ha! Anyway, so they can't do anything about it, and he even has the stuff to say "Sorry about the mix up, I'll be happy to order you another one though." Urgh...

Funny thing, the BMW dealers in the other section of the dealership are way more respectful of you. I think that the Mini people think that they have something expensive, when they don't. Its just that people want them.

Does anyone think that she has any legal grounds as she had a $1000 deposit on the car?

seeing as there is no guarenteed date of delivery in writing the only thing she is entitled to is continued waited at that delearship or if she's smart she'll demand her money back and take her business elsewhere
