United-Kingdom Handbrake Failure - 04' plate

Hi

Advice needed - I purchased a 2nd hand MCS Conv in Sept last year. The car was only 1 yr old with 10, 000 mile on the clock. I immediatley experienced problems with the reverse park sensors not working - I organised a date to have the sensors replaced and the dealership came to collect my car from work (they sent a driver) - the driver reversed my car into another car!! - They took my car away and repaired the damage and sensors and I wrote on the job card 'check handbrake'... the car was returned the next day and there was no mention that the handbrake was not checked.

2 days later... I parked my car at work (same place as usual, on a slight incline) with the handbrake on and 30mins later I was advised that my car had rolled into 2 other cars!! - I have 2 witnesses (the guy who owned the car I damaged and his work colleague) who got into my car, before I did, and confirmed that the handbrake was on and that the car should NOT of moved!

I spoke to the dealership who took my car in for intensive tests.. there reply was 'We have checked the handbrake and there is nothing wrong - we have made a slight adjustment to it though' !!!!!!!!!!!!!!!!!!!! - I got the car back and the handbrake is alot tighter!.. we complained but they referred us to BMW customer services... we called BMW C/services and they also said 'the handbrake is not faulty'!!

I am aware that MINI recalled their 2001 & 2003's for handbrake failure and after checking on this website, and others, it seems that this fault is more widely spread than I initially thought..

Any advice on handling dealershiip/BMW customer services?

I am unwilling to claim on my insurance for something that is not my fault!

Every body knows.......... don't rely on the handbrake !! leave it in gear.

Handbrakes often "relax" as the brakes cools and sometimes allowing the car gently repark its self
