United-Kingdom Lady seeks help on Clutch

I wonder if you can help me I have been driving for 4 years and recently bought a mini one convertable it is on an 06 plate and when I purchased the car it had done 20 miles it has now done 3600 miles I am quite concerned I have been recently been experiencing problems with what I am sure is my clutch. It is not guaranteed to happen everyday some days worse than others but when I am changing into 1st or 2nd the car judders almost like it is about to stall due to not applying enough gas but there is plenty of gas being applied. My local BMW dealer is telling me that they are not 100% sure if it is covered under warantee until they strip down to the clutch to find out and I would be looking at £750 labour costs and a further £230 for a clutch kit if they find it to be wear and tear. I am not excessive with the clutch and only depress the clutch to change gear and I am concerned that someone is trying to rip me off.

Dealers vary when it comes to replacing the clutch under warranty. On this forum I've heard of some having clutches replaced at nearly 40,000 miles under warranty. If it was the clutch and due to wear and tear, you would have had to given it some abuse in just 3,600 miles. If it was the clutch, you could probably also find it very easy to find a dealer who would replace it under warranty with your mileage. Can you explain the problem a little more - does it happen when the engine is cold or warm for example? Does the judder disappear if you keep you foot down on the accelerator, or do you have to lift off the throttle for it to disappear?

It seems to be worse when the car is warm but is also still there when it is running cold with regards to the acceleration the judder starts when i lift off the clutch at the end of the gear change and depress the acceleration one the clutch it totally lifted it stops at this point I am obviously using more gas. It feels as if I am not applying enough gas that kind of judder but there is plenty of acceleration being supplied.

This is very likely to be a warranty job, but would get a second opinion by going to another dealer if possible. Another avenue is BMW Mini customer service.
