Dark Silver Service manager states Software upgrade does not apply to my 2002 S PLEASE HELP

My service manager at Mini is claiming that my 2002 S which was built in Aug. 02 does not fall within the production number to accept the upgrade, I have 11000 miles on my S and I am feeling a dead spot when shifting from 1st to 2nd when I jump on it.
Of course it did not do it for them. Has anyone heard about production numbers not being able to accept the upgrade?

I have same loss of power shifting 1-2 or 2-3 at high RPM's.Dealer thinks I'm crazy,also says that new update is for cold starts only.

Did you call MINIUSA? (1-866-ASK-MINI)

Get them involved. That's the kind of information they should look up for you. Ask to talk to Jenn. She is familiar with the DME software upgrade issues. She is there Monday thru Friday from 12 Noon (EST).

Will Do and I will reply with a update.
I just was entering a highway and as soon as I shifted into 2nd COMPLETE SHUT DOWN for 2-3 seconds. I am getting concerned that I had the car there 3 times with no results with the dead spot. I did however receive a scratch !
