Offline | Not paying finance I have a few faults with my R56 MCS.Some have been fixed and others are still awaiting a fix! Do I have any rights to not paying my finance?I have been told by mini that I have to wait untill the fix is avalible!!! COOPER S |

Offline | Chip i would be very careful with this i would ask the dealer to contact Mini finance if it's with them due to circumstances but if you have loan car may be hard would be good will gesture don't stop any payment unless got written confirmation or may affect your credit rating |

Offline | Under s75 of the Consumer Credit Act the finance provider is usually jointly liable for any defects in the car. You should serve notice on mini finance that you are holding them liable for any defects in your car. But for the time being I would advise continuing to make the payments as and when they fall due. |

![]() You can put lipstick on.. | Your car could be reposessed if you fail to make the payments in line with the agreement even though it has not been in your posession. In normal circumstances you will recieve written notification from the finance company asking you to resume payments, but if you fail to agree a solution it can get a bit messy. Ideally you should contact them and explain the situation and then depending on the response take some form of action. |
