White Cooper Option or Mod?

I have recently had the JCW Aero Kit fitted to my R56 Cooper S. When I phoned my insurace company, Zurich Connect, to advise them I'd had the 'Factory approved Aero Kit ' fitted by Mini, I was absolutely amazed when told that, as it had not been fitted when I purchased the car from new, it would be classed as a mod. They would not provide cover for mods of any type.
As I am not prepared to drive my 20k plus car only two thirds insured, I had no alternative but to cancel my policy mid-term, and then seek cover elsewhere.
Funny, but I had no problems with my new insurance company Admiral.
So, who decides when an option becomes a mod?

Options are fitted before the car is delivered from new. Mods are done after the car has left the show room. That is the difference for most insurance companies. With JCW stuff it's a;ways easier to tell them they were fitted from new.
