Am I being done?

I recently bought and picked up my new Mini Coupé.
While sorting out the finance agreement I asked the dealer if I would have to pay anything on top of the deposit for the first month (because the deposit was going to wipe me out for the rest of the month).
He said no, I would only have to start paying the monthly payments starting from March.
'GREAT' I thought.
So I dropped off my old Mini One on the 31st and exchanged it for the Coup'. I still have a year left on my Mini One and had to pay a settlement fig. But because they wanted me to swap they took they sorted it so that I didn't have to pay full price for the settlement.

Well 4 (On the 4th Feb) days later i was checking my bank balance online when I noticed that Mini finance hand taken the monthly payment of my old car. I called Mini finance and asked if I payed in advance of the month or retrospectively. They said that I was paying for the upcoming month.

I asked well since I dont have the Mini One anymore why am I paying for it for the month of Feb? They said that I still had the car because they had not received any paperwork from the dealer saying otherwise. I then called my dealership who told me the Salesperson I was dealing with is away. I then told them what had happened and they said they would sort it out.

Two days later they called me saying that the agreement I had signed said that I would pay the following months Mini One payment as part of the settlement. I asked to see this and he said that he was just about to head home and that he had the following day off work and I should come in on Thursday.

Well I went in on Thursday and they had a document saying that the next months payment would be taken out. I had never seen that document before and he said that they do not usually show customers the document but it should have been explained to me that they would be taking payment as part of my settlement.

Does this sound right to anyone else, or does it seem like the dealership didnt send the paperwork off in time and are now covering their backs?

really hard to tell as it depends what was discussed and what was signed at the time.

when you say you didn't pay full price for the settlement, could this be less the next payment which they took for February ?

What was left of the settlement went into the price of the Coupé... :s

If you have paid a settlement figure on the finance then you should not be paying for it for any of the months afterwards.

The settlement figure would have cleared the finance and then allowed you to sell the car to the dealers. I assumed that the dealer has paid off part of the settlement figure as opposed to buying the car off you which has left you with a smaller settlement figure?

Did you pay this smaller figure in full? If so you should not be paying any direct debits on it at all.

If you didnt pay the smaller figure then I assume it will continue to come out of your account until it is covered?

Either way you need to get it cleared up and sorted asap.
