54 plate gearbox issue comments & advice please!!!!

i recently purchased a mini one 10 days ago. within this i've had several occasions when the car just wont go from second into 3rd gear. also when putting it into reverse there is a huge crunching noise when trying to reverse then pull it out and back into revers then it moves off. i mentioned this problem to my local bmw mini dealer (when going down 6 days ago about a tyre pressure light that keeps coming on) who said it was my driving? ive taken it down today along with the same tyre pressure light thats come back on again and also a seat reclining issue. the mechanic took it for a test drive and came back saying he didn't notice any problems and he fixed my seat but ive booked it in tomorrow to get a full check over. when sitting there they asked for all my details then came out with that my warranty ran out 3 days ago and i would have to pay for any problems. when taking it down to them 6 days ago no one said to me 'oh by the way your warranty's running out in 3 days would you like to renew it'

if a problem with the gear box/clutch is found would i be liable to pay or do you think i have a stong enough case my minis only done 12k miles! even so renewing the warranty is not cheap do you think they would fix it under the warranty that just expired seeing as its only 3 days out? and i did mention it to them 6 days ago.

really stuck have had the car not even 10 days and have had too many problems. advice and comments would be grateful.

You have to pause between going forwards and backwards - reverse has no synchromesh

just to clear something up im talking about having to move the gear stick out of reverse then move the gear stick back into reverse, im not talking about moving the car, as obviously you need to pause between moving backwards and forwards

the gear box is a sticky box but if it won't go in then this not good nor is crunching....

in terms of warranty they should have sent all of the paper work through the post way before the warranty was going to run.... hmmmm

i would go down there and speak my mind!

has anyone else had a similar problem with this gearbox i was advised not to buy a pre 04 plate because of issues with the midland gearbox and am surprised i'm having problems on a car with such low mileage.
