Mini Back Fire an issue?

hi i am new to this forum, but i bought a 2005 Mini Cooper S and i have been driving it for about a month now. i noticed a back fire sound after about a week of driving it around. this is through all gears to when i let off the gas my car just back fires. now i took it back to the dealer and they hooked it up to their machine and did a diagnostics check on it and they told me there is nothing wrong. one of their specialist who says they know alot about BMWs said that it is going to back fire casue it has a super charger and an after market cold air intake on it. do i have a major problem or is the dealer right? what might be the issues?

Here you go... From motoringfile:

Quote:
Subject: Model Year 2005 MINI Cooper S Popping From Exhaust

Complaint: The vehicle exhibits an acoustic feedback of the exhaust system under the following conditions: Engine braking in 1st, 2nd, or 3rd gear. Increasing engine speed above 3000 rpm while the vehicle is stationary

The popping noise from the exhaust system can also be described as a “backfire” from the engine.

Measure: Do not attempt to repair or replace any parts, this is not a failure of any driveline components. The acoustic feedback is a standard feature of the 2005 Model Year Cooper S vehicle produced as of 7/2004. This feature cannot be retrofitted to the previous model year vehicles.
