United-States brakes fail twice at slow speed

My wife has also had a problem with the brakes failing at slow speeds on her 2005 Mini Cooper (BTW, she loves the car). This happened after 9000 miles without a problem at which time the power steering went bad while I was driving the car and they changed all the fluids when they fixed the car. Then two weeks later, while she was parking in a spot in a parking lot, the brakes failed and and she hit a tree. The second time she was parking in our driveway and she hit our house. She couldn't have been going more than 2-4 miles an hour each time. We were lucky that she didn't have this problem in a crosswalk where people are crossing the street. In 29 years of driving she has never put a scratch on any car that we have had. She is not sure if there was a clicking noise or not. We were also told that Mini/BMW has never heard of this happening before. I consider myself a reasonable person and told them that we still love the car and realize that A CAR can have a problem-of course this is a dangerous one. As an aside, I own one BMW and two Minis from this dealership. All of this made no difference. Of course, we know that this has happened to others on many occasions. The first time they convinced us that she possibly had her foot on the brake and the gas at the same time due to the closeness of the pedals. We fixed this through our insurance. Everyone at Mini & BMW started acting really strange-even to my insurance company when dealing with this. My wife was terrified to drive the car. But we were convinced that there was an outside possibility that what they said happened. So the second day after driving the car, the brakes again failed at a slow speed and she hit our house. This could not happen twice. My wife would no longer drive the car and I agree that no one should drive this car. BMW claims that nothing shows up on their computers, so they believe that nothing was wrong. It seems like they tell everyone this. But-they immediately offered to buy back the car and give me a voucher toward a new one. I thought that they were being very reasonable and understanding at this point. They even paid for the rental while this was going on. But when I thought that this was a done deal after 3 weeks of the dealership, not returning my calls, I was left a message at home, even though they always know that they need to reach me at work, that they could not find me a car comparable to the one I had and they wanted to know when was my insurance going to fix the car? They now want me to pay to fix the car (now , at their cost). They will then buy it back at a ridiculously low amount and I'm stuck having to buy a new car. I have the car a year and I have not had use of the car for at least 70 days due to this problem. I need some help & advice. I have never had this kind of dealing with anyone before. They actually don't really care. I'm strongly considering involving the local media and getting a lawyer to deal with this (although I'm not one who believes in using lawyers to settle things when it should be easy to settle something in a reasonable way that is fair to everyone. Has anyone else had this kind of problem with Mini/BMW. Suggestions, please

wierd...didnt the handbrake work either?

i've had my brakes fail completely at 70mph in a car (twice...)...but i suppose i had enough time to use the handbrake to slow me down as i was approaching a roundabout...and another time i lost the front brakes on my exup...but each time the brake fluid was literally pouring out of the vehicles.

was it like foot to the floor dead brakes...? i dont know if the pedal is sprung on a mini, but on my old car the pedal was laying on the floor under its own weight when they failed.

is it possible that the discs had been pushed back into their calipers and created a gap and therefore a lag? i've heard of this happening when going through water or on bikes after a tankslapper.

hope you get it sorted...i'd be inclined to perhaps see if you can recreate the scenario somewhere safe and go from there.

does it feel like the abs is kicking on, ive had wheel speed sensors fail and when brakes are applied it thinks a wheel is locking up and activates the abs and in a normal dry condition you will drift further than usual

I know one person from these threads who was taking the case to lawyers against bmw. I dont know the outcome of the case, or whether it actually went to court but Im sure I can dig the details out for you.
