Offline | Oh my god!!! How angry am I!! ![]() Was driving round the roundabout when I hear a great bit THUD. Some stupid cow in a Clio just went into the side of my car!!!!! She was in the wrong lane going round the roundabout - It was the one outside Derek Woodman if anybody knows it! Funny thing is she was test driving the car from Renault, Blackpool with her parents. Nobody from Renault was in the car when it happened but it had one of them red number plate things in the window. We exchanged details etc and I spoke to the guy from Renault who said they will sort the damage out. However I'm a bit concerned as in approximately 4 weeks time I'm part exchanging this car for a brand new Dooper. I guess the damage could be far worse than it is but i'm unbelievably off!! Trust this to be my luck!! ![]() What is the best way to go about this? Let Renault fix it? It's a 55 One D that I only bought last October and I've been offered a brill price as my part ex. I just don't want this to up when i go and get my new car. Also do i let my insurance company know? ![]() Aaaaaaaaaarrrghhhhhh ![]() Last edited by Paul : Mar 16th, 2008 at 08:02 PM. |

Offline | Yeah definately, if the car has trade plates on it someone from the actual company should be in the car!! It shouldnt effect your trade in as long as they get it fixed soon. ![]() |

Offline | There is case law on this. Even though they may meet the cost of the repair; if, in addition, you suffer a loss on trade-in as a result of the damage, the other party is liable for this loss as well. |

| Not the best | Shoot thats a pain in the arse - We had that with our Vectra before the R50 Mini - Took it out to do a final check, then some Honda Civic took a smack out of the rear bumper :@ Costs were fortunatly all recovered though - Hope the same rubs off on yourself ![]() Last edited by minicabrio : Mar 17th, 2008 at 12:25 PM. Offline | I would agree with that and considering the law in regards to a vehicle being driven with trade plates I'm sure they'll be eager to keep you happy. Maybe they can also throw in some additional driving lessons for the young lady in the Clio. Just a pain to deal with the inconvenience, hope it gets sorted soon! Cheers, Geoff. |

| Trained Monkey | I would want to verify the situation on this, but I am pretty certain putting trade plates in the window(s) is NOT enough (despite being commonplace), I am sure that legally speaking they should be attached securely to the front and rear of the vehicle. In a previous life I worked on creating interactive training materials, some of which was for car dealerships, and they made a point of highlighting the often ignored laws/regulations on trade plates. ![]() There aint no party like my nana's tea party |

Offline | Strikes me the Renault garage are in a world of poo!-they have released a car on public highway without insurance cover There perhaps exists the possibility that they purchase your car from you at the price that you were offered by the MINI dealership plus an amount for the stress and inconvenience that you will have. they dont have a case to argue! |

| Trained Monkey | This got me thinking. I think they've been really naughty, and this could end up complicated. The following may help: The Road Vehicles (Registration and Licensing) Regulations 2002 Vehicle Excise and Registration Act 1994 (c. 22) This part I think relates to what I was saying: (I couldn't figure out if they should have been in the car with the Clio driver or not, even if they were displaying the plates as required). ----------------- Display of general registration mark of holder of a trade licence and exhibition of licence 42. - (1) Where a vehicle is in use under a trade licence the general registration mark assigned to the holder of a trade licence shall be displayed on the vehicle in the manner specified in paragraph (2). (2) The trade plates issued by the Secretary of State shall be fixed to and displayed on the vehicle in such a manner that, if the general registration mark assigned to the holder were a registration mark assigned to the vehicle, the provisions of regulations 5 and 6 of the Road Vehicles (Display of Registration Marks) Regulations 2001[17] (the "2001 Regulations") would be complied with, notwithstanding the vehicle may not have been first registered on or after the relevant date, as defined in regulation 2(1) of the 2001 Regulations, or it is a works truck (as defined by paragraph 4(6) of Schedule 1 to the 1994 Act) or an agricultural machine (as defined by regulation 2(1) of the 2001 Regulations) or a road roller. (3) The prescribed manner of exhibiting a trade licence on a vehicle for the purposes of section 33(1)(b) of the 1994 Act is that specified in paragraph (4). (4) The trade licence shall be - (a) exhibited on the front of the vehicle so as to be clearly visible at all times in daylight; and (b) fixed by means of the trade plate issued to the licence holder which contains a means for fixing the licence to it. --------------- There aint no party like my nana's tea party |

Offline | Oh no!! That's a real pain. Yes, I think you should inform your insurance, pronto, personally I wouldn't let them repair it either, it should go to your choice of repairer, not theirs. They are on a really sticky wicket here, technically there should be some official type of reporting of the circumstances but obviously that's your call. Good luck, hope its sorted for Dooper Day. |

Inform your insurance, possibly (but not sure) the police (if you think something is up, I know I personally would, but your call), and get it all done above board and legit, and at your choice of repair place.
