Afternoon Emma, Sorry to hear about your misfortune. The only advice I can give at this moment is get capital bank to argue your case, do not stop paying finance as this will cause more problems. The finance company should take up your case as the vehicle is theirs until you have paid off the finance. Also if you dont get any help with that tell the dealer that you are going to the local press about there handling of this. Ask the dealer have they gone back to the old drive and check for faults not just rely on the computer!!

Keep paying the finance and get them to sort it out. Email MINI Customer service, they don't do much but will contact the dealer and give them a push. Keep a record of everything and write a letter to the dealer principal giving them a short timescale to respond to your complaints. Good luck and keep us updated.

Although I wouldn't disagree with the statement above I wouldn't advise this course of action in your situation. If MINI, Capital Bank, or your dealer found out that someone other than them had had you rcar in pieces you wouldn't stand a chance of gettingnanything out of them. That and the fact that you will end up having to pay a specialist when your problem is likely a warranty issue. As has been said keep paying the finance, you will only ruin your credit history if you don't. Write to your fiance company, with copies to your dealer principle, and MINI UK. This letter should state that you want to reject the car because of the problems you have had emphasising that it has been this way from day one and the repairs that have been carried out. Hopefully you have a comprehensive log of events and repairs. Put it all down in black and white. As has been said your finance company owns the car until you have paid the last installment. So should you stop paying for it they will have to sell it on after repossession, and they won't be able to if it's faulty. Because of this they are the best people to fight your corner as the dealers tend to lsten to them Having been through a similar situation with a previous car I would always recommend having some finance on any car, if only part of it. You can't do this if you have a bank loan or have paid cash, you have to fight for yourself. When I did what I have described my Omega was changed within the week. The dealers attitude changed completely once Black Horse got involved. Good luck.

the dealer needs to take the car off you and repair it...........and give you a courtesy car while they have your car. if your car has been off the road for repairs for 6 months out of 18 months I would say you have the right to a brand new replacement vehicle, and if you are taking legal advice I'm sure this is what they will say. personally if it was me I would get shot of the car as I just do not have the time or patience to waste on a duff mini !! trade it in for a golf or similar and let someone else have the hassle !!
