Offline | When should BMW replace a faulty car This isn't related to MINI but BMW. A colleague has an X5 that is less than a year old and is having no ends of problems with it. In the time she has owned it it has been back to the dealer half a dozen times with engine problems. This time they have had it for four weeks and it turns out they still don't have a fix for its very Smokey engine, it is a diesel but shouldn't smoke like big old London bus. When should BMW offer to replace the car? Her dealer has had BMW UK technicians in and is now having a specialist from Germany fly over to inspect it.....this is cheaper than having either the car or engine replaced. Can she refuse to take the car back and demand they replace it with a new X5? we does she stand legally? All Cooped Up Keep on Motoring........ |

Offline | I have no idea about "Lemon" or "consumer" laws in the UK, but your best bet is to either call a lawyer that specializes in consumer law or do an internet search to find out about consumer protection sites and what are the general rules to follow when dealing with defective goods such as cars. |

Offline | Tell her to speak to the Citizens Advice Bureaux, failing that, get her to sell it privately, she'll make more money on it that she brought it for!! BMW are right w******/t******/b*******/c**** when it come to having your car fixed, I had a 318is for 2 years and it took over a year to fix a few minor and a couple of major problems, not once would they consider changing the car... I got it for £13,500 and they spent more than £7,000 on warrenty work in 1 year!!! (Though I think it might have been because the charge BMW for the work and make a profit). BMW = Bad. MINI = Finger crossed nothing bad happens to it. 2002 Porsche Boxster |

![]() 6X therapist | Covered in loads of other messages on different threads, the fact is dealers will never admit thet there is such a thing as a bad car, you have to try really hard and summon up legal guns before you get a result. Independent advice from a respected org. like RAC or AA can help, sometimes car mags will jump on a case if they think its news worthy. Basically stick to your guns and get everything in writing. I think its maybe time for a sticky Legal and dealership thread where all these posts can be covered, maybe a whole legal Menu section, there must be one or two barrister.solicitior types out there who could privide a guide. |
