Angry Refund of your Deposit?

Anybody know how you stand with getting your deposit back in the UK (£500) once the car has been delivered (unregistered) to the dealer and you decide that you don’t want it? They are supposedly ‘desirable’, but I can’t sell my existing ONED, despite widespread advertising, so it looks like I will maybe keep it. The garage has said that I lose my deposit. This seems pretty sharp practice, as they should have no problem in selling the new one, presumably at full list price?
Would be grateful for some advice.

Im not sure about the selling business but your dealer is right not to give you your £500 when you signed for it it came under all the clawses that are in the contact etc...
There shouldent be a problem selling it though if its brand new....

Over here in the states my dealer told me the deposit could be refunded up until the car was actually being made. After that, the deposit was forfeited if I decided not to get the car. This was stipulated in the paperwork that I received when I put the money down.

It is a little stiff sounding, but you cost the dealership money by not picking up the car. Yeah, they should be able to sell it off the lot, but it still cost them something to process your order. You also cost them one of their allotted MINI's that could have been ordered for someone else.

Depends what was signed/agreed to when you placed the order, if anything? Not sure on what the legal "standard" is though to be honest.

Name and shame. I want to know just so that I can avoid your dealer.

Most BMW/MINI dealers are pretty good at refunding deposits on unwanted cars, even up to the point of delivery.

On mass market and less desirable cars it is more the norm to forfeit your deposit and even be pursued to complete the contract or pay damages.

i was told, when i put my deposit down (last september). That its usual to get your deposit back, as someone else will snap up your MINI (or place in the production line), up to the point of no return (i.e. production date). After that its purely down to the discretion of the dealer.

Could you not trade it in against the price of your new car?

I don't think the dealer holding you to a contract you signed of your own free will "sharp practice" - I'm sure you would be the first to enforce contractual details if it was in your favour. Although they may have no problem selling the car, the pool of potential buyers may be smaller as they have not had the chance to order it to their specs - like you did.

I had no problems at all at getting back my refund of £500 when I cancelled an earlier MINI order.

What was the spec of the MINI you cancelled as most MINI dealers don't care for cars that either have no air con or sunroof. They say they are too hard to sell on - whether this is true or not I don't know.

I sold my MINI without aircon with no trouble at all.

The dealers usually state that they will return the deposit when they sell the car, fair enough really. If they will not return the deposit even after they sell it, name and shame them. That way they will lose business, not just yours, in the future.

Have a look over in http://www.honestjohn.co.uk/home/index.htm for a thread where a dealer (not a MINI dealer though) refused to refund a £1000 deposit.

They delivered a cheque by hand when the small claims court papers turned up.

I was told by my local dealer that the earliest I cold get a MINI one D was November, and that they sold their demonstrator, and had not been able to replace it. Maybe you need to advertise a bit more precisely to your market, (e.g. motoring press rather than local rag.) Or part ex
