Hi Guys
so i am in need of some help.
i have a 2001 mini cooper and in December i had a gearbox go on me (common issue with the early midlands gearboxes, as you probably all know) and i bought a gearbox from a well known supplier of re-furbished one with good reviews.
I had the gearbox fitted by a different independent garage that is very well known and carries out gearbox changes on many different vehicles from minis to Audi R8's or 911's the car was at this garage when the original gear box went and moving it was very difficult so they fitted the re-conned box.
unfortunately the gearbox went again on Sunday the 27th after 4000 mile s and only 4 moths. The box didn't give any warning no noises it just went bang and there was a lot of gearbox oil on the floor i pulled over straight away the wheels have not locked up and the car still operates but the gear box has diffidently gone and the AA confirmed this. we were on the way back from a family meal late on Sunday and being towed home in the storm we had, for 2 hours was not great.
I do not think this is a reflection on the company that i bought the gearbox from but i do need to know my options on this matter.
The company have offered to fit a new box for a labor charge of £120 which i am happy to pay for as they didn't fit the box originally. But they are asking for another surcharge of £250 as the casing is damages (oil on floor indicates) which i do not believe i am entitled to pay as i have already payed the surcharge on my fist gear box, and this ones fault was not a fault of my own. The gearbox also has a warranty of 12 months and 12 thousand miles which i am no where near.
The car is currently in Guildford Surrey and would need to be towed about an hour away to be sorted which seems to be at the cost of myself which i am also not sure if this is correct as i am not at fault.
can anyone please let me know where i stand on this matter and if anyone has experienced this before, i really need help as this cost me over 1000 pound only 4 months ago and i do not believe this is my fault at all.
