Roof wear on my 5 month old car

I've got Roof wear on my 5 month old car
I took to Dealer this morning, where they took photos & notes etc!
I've been told to await BMW's comments.
However, I will pursue a rejection/repair notice to Dealer Principal, requiring them to prove roof was fit for purpose, of reasonable quality & not fauly from new (Its a 6 mth deadline rule within sales & goods act 1979 - after that time, you have to disprove the fact).

I'll keep you guys posted!

I'd be interested in the outcome of this. I've just had a new roof and it still looks good -not sure for how long!

I think that's a very good approach Sxhinkle - the dealer MUST respond to a challenge like that, and your outcome would be meaningful for many other owners too.....good luck!

Now there seems to be a consumer orientated approach to this problem. Do we need to resurect this poll?-or try a similar one?

Does this notice apply to those who've had their car over 6 months but had their roof replaced just a month ago to find that it's got bad wear already?

Update

I issued the following letter, recorded delivery on 12th & had call today 17th to say BMW would fit a new roof! If that new roof wears after 3 months, I'll issue another letter & another!

Dear Sir/Madam,

Re: Car Reg

On 01/03/05 I bought the above vehicle (MINI, Cooper S Convertible, 1600cc) from you. On date xx/xx/xx it developed evidence of a serious defect of the Fabric Roof Wearing as part of the folding process.

The Sale Of Goods Act requires you to supply goods of satisfactory quality. As the defect described above is not consistent with the age of this vehicle, you are now in breach of contract.

In these circumstances, I am legally entitled to financial compensation. However, while reserving my rights under the Sales of Goods Act, I am prepared to give you an opportunity to repair the defect without any charge to me.
Please let me know what arrangements you can make to undertake this work speedily.

I look forward to receiving your proposals for repair within the next 14 days.

I too have the dreaded symetrical white wear marks. Took it to the dealer today to "go on record" with the problem . They instantly offered to replace the top....no questions.

Mine is already showing white marks after 3 weeks. Mine is 2005 British racing green Cooper S with green roof.

Pardon me for asking, but is roof wear likely to happen due to hot weather / sunlight as well (most likely I'm assuming?)? Only that I am considering a cabrio but our weather here shows no mercy; averages around 45 C in July / August and can go to 50 C as well! How fast would that ruin the roof for me?

We do got nice weather in the few months when it's not summer so I think a cabrio is worth it, but I am worried about roof-wear and air-conditioning as well. And there is the problem with the rear-view mirror as well.

only had my lovely mini henry for 3 months and have slight white marking on the roof but i have noticed that on the rear quarter windows on both sides they are scratching on the rear edge has anyone else had this ?

I just put my car into Richmond Mini (in Vancouver Canada) to have the Roof replaced. I had quoted the TSB number that I found on this forum and had no problems getting the dealer to order the replacement. The Car and old Roof are 11 months old. The wear started within a month of purchasing the car but I let the dust settle before going ahead.
Thanks to everyone on this forum for getting this problem publicised and accepted my Mini.
I will let you know how the new roof goes - I am very wary, considering the repeated problems people are having.

United-States Roof to be replaced

I took my 05 MCSC, Nov 04 build, in for the first scheduled maintenance a couple of weeks ago. Dealer is MINI of Towson (MD). Showed them the wear marks. When I picked up my car they said my roof would be replaced. Parts were ordered and I was notified yesterday that the parts are in and I should bring the car back in for the install. Will post after work is completed. I'm a little concerned as my top fits well and doesn't leak even in very heavy downpours. Any guidance or experience to share. Feel free to PM me.

Not sure if this is common knowledge now and I've missed something but I've just recieved a letter from my Mini dealer basically recalling my car. They state that chaffing may occur on the soft top and they want to check it over and adjust if necessary,

Took my car in for its 1st service yesterday. I mentioned the marks as one of a small list of issues I was concerned about. They called be last night to say that they were going to replace the top. I pick it up this evening after work. I hope things are alright. I look forward to hearing about what they have done to keep it from happening again. I really hope that they did not just replace the top without making any type of adjustment.

I really was expecting them to put up a little bit of a fight about the marks. My dealer is being proactive about it. At least it seems so.

So far, so good. The rattle over the driverside window is gone. I hope that they connected everything up correctly. We were asked not to use the top in any way for two weeks. Not sure why, but it is not a problem right now anyway. The new top looks great. Like a new car again.

I will keep an eye on it.

Question Top Being Replaced

My car has been at MINI of Towson, MD for almost 2 weeks. Top is being replaced due to excessive wear. Hope to pick it up on Friday if the ice storm isn't too bad tomorrow. I hope I am not the first top replacement they have performed.

I have heard that other dealers are taking many days to do it. My dealer had it donce by 8 PM after starting around 4 PM. Kind of had me worried. I was actaully shocked that the dealer had a roof ready the day I took it in.

The mechanic did not want to go home with all of the rush hour "storm" traffic so he stayed late to finish it that night instead of putting it off until morning. They had my car a total of two days due to a number of little things. Good luck with the new roof. We have noticed a few wrinkles. but we will see what happens with that after we start using the top.

Mini Cooper S Convertible - Roof Wear

I was, but still might be joining the Mini set.
I'm looking to enter at Cooper S Convertible level. Now I have been reading quite a bit about roof wear. I spoke to my prospective Dealer about this (Chandlers in Rustington) and at first they said they have not heard of any problems.
At a later meeting they said that there were problems but they have been solved with a roof modification (reinforcement patch).
I examined the convertible example they had and found some clear plastic stitched around the problem area. Is this how BMW solved the roof wear problems and has it worked.
I currently have a convertible and get the roof down whenever I can so this new Mini roof is going to get quite a hammering.

England I've fallen for a convertable.

Hi All,

After weeks of pawing over car magazines for something that would give as much pleasure as my existing Mini I've taken the plunge for a Cooper S conertable. Looks like delivery will be in April, so will report on the roof wear as soon as it's had a few weeks use. I forgot to ask the dealer about this ongoing problem, but will no doubt be paying several visits to the showroom over the long wait, so will have plenty of opportunity to grill them

And so the long wait begins
