United-States Appeals court rules passive pressure monitors are not good enough

The NHTSA has mandated that all 2004 MY cars should have pressure monitors and said that passive was OK but a court has ruled that systems which use ABS sensors, like the MINI, are wrong half the time and just aren't good enough.

I wonder what this means for the MINI in USA in future model years?

I did't know that the mini system used the ABS sensors to detect wheelspeed / circumference!
I was under the impression that they had the pressure sensor air valves fitted...No?
