MINI Mk2 Headlamps stuck on and other wierdness!

Can anyone help with this?
My wife's 2008 Cooper Diesel does not have auto lights, there is only the; off, side and head positions on the stalk.

With the ignition on, the headlamps don't work, the sidelights are OK but not headlamps.
Then, with the engine running both head and sidelights come on (and won't go off)
The engine auto stop/start function doesn't work either (not so bothered about this).
I'm not sure how long this has been going on, but it certainly wasn't doing it when we got the car which was s/h but still in warranty.
Out of warranty now though
It's all a bit weird

a weak bettery will cause no end of weirdness in minis ... have the battery voltage and load capacity checked
