Question oil coming from a breather ?

i have oil being pushed back up from what i think is a breather under the crank case cover, any ideas why?

also,
just noticed that i have for what i would call a pips securer missing from my top end, as in the pic below, is your Cooper S the same as mine ?

I took the car into BMW the other day and they had a master tech have a quick look under the bonnet and he said to me, if there was not a bit of oil coming out from there he would be worried as this is normal,

Mine leaks at that place just a touch, not as much as yours. Its very minor and not worth worrying about, degrease it & it will look fine for quite a while. The black breather pipe that fits into the cover where the leak is, is held very loosely & oil is probably seeping out. The pipe can pull off with hardly any force at all and u will find its oily inside.
