Melting MCS hood scoop!

After getting back from a long road trip last month, I noticed that the hood scoop on my '08 Clubman S had warped. Sitting right over the turbo, it must get pretty hot. I see that there are several heat shields available aftermarket for what they call a "common" problem.

Questions:
A) Has Mini taken responsibility for this problem? Has there been a recall I missed? Has anybody had success in getting the scoop replaced after warranty's out?
B) Any advice on heat shields? I see one (offered by MiniMania) is described as factory original, though neither of my 2nd gen MINIs has anything like that under the hood.

Mines got a BMW genuine heat shield fitted under the bonnet above the turbo, I fitted it because I thought the bonnet was getting too much heat transferred to it.
Its like a black padded blanket about 300mm squarish or so and cost me I think 45

Go to bmminiparts site and see and order one or your dealer
Pt no 2755612 heat insulation pad engine lid
plus 4 x expanding rivets Pt no. 1915964
