Cooling fans failing to operate

My 2011 cooper D has the 2 speed fan, I noticed the fan wasn't coming on when the a/c is turned on, I plugged in my obd scanner and got fault code 41F1 DDE has detected a short circuit to ground, I've fitted a brand new fan as that was recommended as the resistor attached can fail, but still the fault code remains and fan not working, I got the mini up to temp 109C and the safe mode kicked in so fan speed 2 is not working either, seen so many posts on this code and fans not working but so little resolves or fixes, I've check every fuse and relay, sensors etc and tested all the wires for continuity. has anyone had this and fixed it ? been told it could be the bcm but don't know how you test those.
